Agreement

Welcome to Glamily! Please read these Terms of Service carefully before using the services offered by Glamily Inc., ("Glamily").

These Terms of Use govern your use of Glamily and provide information about the Glamily Service, outlined below. When you create a Glamily account or use Glamily or use any tools, applications, and services associated with Glamily you agree to these terms.

The Glamily Service is provided to you by Glamily, Inc. These Terms of Use, therefore, constitute an agreement between you and Glamily, Inc. The Services are owned and operated by Glamily. Glamily has the right at any time to change or discontinue any aspect or feature of the Services including, without limitation, the content and software needed for access or use.

By accessing this Service or using any part of the Service or any content or Services hereof, you agree to be bound by all of its terms and conditions which may be amended from time to time. If you do not agree to these terms, you may not access or use the Service.

The terms "We", "Us", and "Glamily" refer to Glamily. The terms "You" and "Your" refer to you, as a visitor or user of the Service.

ARBITRATION NOTICE: YOU AGREE THAT DISPUTES BETWEEN YOU AND US WILL BE RESOLVED BY BINDING, INDIVIDUAL ARBITRATION AND YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. WE EXPLAIN SOME EXCEPTIONS AND HOW YOU CAN OPT OUT OF ARBITRATION BELOW.

The Glamily Service

We agree to provide you with the Glamily Service. The Service includes all of the Glamily products, features, applications, services, technologies, and software that we provide to advance Glamily's mission: help users stay connected with the most relevant people, products, and content to glam up themselves. The Service is made up of the following aspects (the Service):

Glamily Rewards

Glamily is a community platform with a dynamic rewarding system. Glamily Rewards (the "Program") enables you to earn redeemable points for activities such as qualified friend invitations, check-ins, and other offers from Glamily. Offers may vary by market. Glamily may offer additional opportunities to earn points from time to time, and each points-earning offer will not be available in perpetuity. Your earned points can be redeemed for items ("Rewards") in the redeem page. For more information see the Rewards section at Glamily Help Center.

Program Requirements. You need a valid Glamily account. The Program is open to users who reside in the USA. Individuals can have no more than one Program account, even if an individual has multiple accounts, and households are limited to two accounts. The Program is solely for your personal and noncommercial use.
Points. You cannot transfer points. Points are not your personal property, and you may not obtain any cash or money in exchange for them. Points are awarded to you on a promotional basis. You cannot purchase points. Glamily may limit the quantity of points or Rewards per person, per household, or over a set period (e.g., a day) provided that you are not disadvantaged in breach of good faith. You may redeem no more than 1,000,000 points per calendar year in the Program. Points earned in the Program are not valid in, and may not be used in combination with, any other program offered by Glamily or third parties. Unredeemed points expire if you do not earn or redeem any points for 6 months.
Rewards. You may redeem your points by visiting the Glamily redeem page. There may be a limited number of a particular Reward available, and those Rewards will be delivered on a first-come, first-served basis. You may be required to provide additional information, like your mailing address and a telephone number (other than a VOIP or toll-free number), and you may also be asked to enter a fraud-prevention code or sign additional legal documents to redeem points for Rewards. Once you order a Reward, you cannot cancel it or return it for a refund of points except in the case of defective products or as required by applicable law. If you order a Reward that is out of stock or unavailable for other reasons, we may substitute a Reward of comparable value or refund your points. Glamily may update the Rewards offered on the redeem page or discontinue offering specific Rewards. Some Rewards may have age eligibility requirements. Any such requirements will be included in the relevant offer. You are responsible for all federal, state, and local taxes and any other costs of accepting and using the Reward. Rewards will be emailed to the email address associated with your Glamily account, so keep your email address up to date. Rewards that are undeliverable will not be reissued and are therefore forfeited. Rewards are not for resale.
Cancelling Your Participation in the Program. Glamily reserves the right to cancel the Program account of a specific user for tampering with, abusing, or defrauding the Program, or for breach of these terms. Upon Program cancellation (by you or us) or if the Program is suspended, you will have 30 days to redeem your points; otherwise, those points will be forfeited. At the point of cancellation, your right to use the Program and accrue future points ends.
Other Conditions. Glamily reserves the right to disqualify you; disable your access to the Program or your Rewards account; and/or withhold points, Rewards and charitable contributions, if Glamily believes you are tampering with or abusing any aspect of the Program or may be engaging in activities that violate these Terms.

Glamily Programs

By joining Glamily and using the Services, you acknowledge that you are not guaranteed to receive anything in return, including Free Glam Gifts, complimentary products and/or any other promotions or giveaways promoted in Glamily, in emails or on other social media sites. Note Glamily adheres to a strict policy of sending one Free Glam Gifts per household address per program, regardless of whether or not multiple qualified users reside in the same household. These requirements are solely determined by Glamily and may change at Glamily's discretion at any time. Glamily reserves the right to postpone, change and/or cancel any scheduled or running programs at any time.

Any items you receive as part of a Glamily promotion (e.g. free products, discounts, prizes, etc.) are NOT FOR RESALE. All products a user receives from Glamily are meant only for the recipient to test, unless otherwise noted, as in the case where recipients are meant to share with a family Member or friend or asked to hold a giveaway. In the case that a user is unable to use a product, he or she may pass along to a friend. In no case is it acceptable for any user to resell a product received through a Glamily Program either online or offline. If a user is found to be exchanging products received via Glamily for cash, their account will be terminated immediately. All the Glamily programs are open to users who reside in the USA.

Offering personalized opportunities to create, connect, communicate, discover, and share

People are different. We want to strengthen your relationships through shared experiences you actually care about. So we build systems that try to understand who and what you and others care about, and use that information to help you create, find, join, and share in experiences that matter to you. Part of that is highlighting content, features, offers, and accounts you might be interested in, and offering ways for you to experience Glamily, based on things you and others do on and off Glamily.

Fostering a positive, inclusive, and safe environment

We develop and use tools and offer resources to our community members that help to make their experiences positive and inclusive, including when we think they might need help. We also have teams and systems that work to combat abuse and violations of our Terms and policies, as well as harmful and deceptive behavior. We use all the information we have—including your information—to try to keep our platform secure. We also may share information about misuse or harmful content with other Glamily Company or law enforcement. Learn more in the Privacy Policy.

Developing and using technologies that help us consistently serve our growing community

Organizing and analyzing information for our growing community is central to our Service. A big part of our Service is creating and using cutting-edge technologies that help us personalize, protect, and improve our Service on an incredibly large scale for a broad global community. Technologies like artificial intelligence and machine learning give us the power to apply complex processes across our Service. Automated technologies also help us ensure the functionality and integrity of our Service.

Ensuring a stable global infrastructure for our Service

To provide our global Service, we must store and transfer data across our systems around the world, including outside of your country of residence. This infrastructure may be owned or operated by Glamily Inc., or its affiliates.

Connecting you with brands, products, and services in ways you care about

We use data from Glamily and other Glamily Company Products, as well as from third-party partners, to show you ads, offers, and other sponsored content that we believe will be meaningful to you. And we try to make that content as relevant as all your other experiences on Glamily.

Research and innovation

We use the information we have to study our Service and collaborate with others on research to make our Service better and contribute to the well-being of our community.

The Privacy Policy

Providing our Service requires collecting and using your information. The Privacy Policy explains how we collect, use, and share information within Glamily. It also explains the many ways you can control your information, including in the Glamily Privacy and Security Settings. You must agree to the Data Policy to use Glamily.

Your Commitments

In return for our commitment to provide the Service, we require you to make the below commitments to us.

Who Can Use Glamily

We want our Service to be as open and inclusive as possible, but we also want it to be safe, secure, and in accordance with the law. So, we need you to commit to a few restrictions in order to be part of the Glamily community.

You must be at least 18 years old.
You must not be prohibited from receiving any aspect of our Service under applicable laws or engaging in payments related Services if you are on an applicable denied party listing.
We must not have previously disabled your account for violation of law or any of our policies.
You must not be a convicted sex offender.

How You Can't Use Glamily

Providing a safe and open Service for a broad community requires that we all do our part.

You can't impersonate others or provide inaccurate information. You don't have to disclose your identity on Glamily, but you must provide us with accurate and up to date information (including registration information). Also, you may not impersonate someone you aren't, and you can't create an account for someone else unless you have their express permission.
You can't do anything unlawful, misleading, or fraudulent or for an illegal or unauthorized purpose.
You can't violate (or help or encourage others to violate) these Terms or our policies, including in particular the Glamily Community Guidelines and Music Guidelines. Learn how to report conduct or content in our Help Center.
You can't do anything to interfere with or impair the intended operation of the Service.
You can't attempt to create accounts or access or collect information in unauthorized ways. This includes creating accounts or collecting information in an automated way without our express permission.
You can't attempt to buy, sell, or transfer any aspect of your account (including your username) or solicit, collect, or use login credentials or badges of other users.
You can't post private or confidential information or do anything that violates someone else's rights, including intellectual property.
You can't use a domain name or URL in your username without our prior written consent.

Permissions You Give to Us

As part of our agreement, you also give us permissions that we need to provide the Service.

We do not claim ownership of your content, but you grant us a license to use it. Nothing is changing about your rights in your content. We do not claim ownership of your content that you post on or through the Service. Instead, when you share, post, or upload content that is covered by intellectual property rights (like photos or videos) on or in connection with our Service, you hereby grant to us a non-exclusive, royalty-free, transferable, sub-licensable, worldwide license to host, use, distribute, modify, run, copy, publicly perform or display, translate, and create derivative works of your content (consistent with your privacy and application settings). You can end this license anytime by deleting your content or account. However, content will continue to appear if you shared it with others and they have not deleted it.
Permission to use your username, profile picture, and information about your relationships and actions with accounts, ads, and sponsored content. You give us permission to show your username, profile picture, and information about your actions (such as likes) or relationships (such as follows) next to or in connection with accounts, ads, offers, and other sponsored content that you follow or engage with that are displayed on Glamily Products, without any compensation to you.
You agree that we can download and install updates to the Service on your device.

Disclosure Agreement

According to the FTC, disclosure should always be "clear", "visible" and "conspicuous". As Glamily is a platform through which you receive products for free, the best way to disclose is to clearly state in your content that you received a product complimentary from the brand. When you share, post, or upload content on or through the service, YOU MUST:

Clearly state if the product was free, discounted, or received as part of a promotion, whether on Glamily or otherwise;
Disclose if you have any financial, employment, family, or personal relationship with the brand or product that is being reviewed; and
Submit content only for items that you have either purchased or used.
Be honest and truthful in your review.

Members who participate in Free Glam Gifts campaigns and other Glamily programs also agree to follow these disclosure terms when participating and communicating about Glamily programs and product sponsors on outside websites, blogs, videos and other platforms.

Additional Rights We Retain

If you select a username or similar identifier for your account, we may change it if we believe it is appropriate or necessary.
If you use content covered by intellectual property rights that we have and make available in our Service, we retain all rights to our content (but not yours).
You must obtain written permission from us to modify, create derivative works of, decompile, or otherwise attempt to extract source code from us.

Content Removal and Disabling or Terminating Your Account

We can remove any content or information you share on the Service if we believe that it violates these Terms of Use, our policies, or we are permitted or required to do so by law. We can refuse to provide or stop providing all or part of the Service to you (including terminating or disabling your account) immediately to protect our community or services.

Our Agreement and What Happens if We Disagree

Our Agreement

Your use of music on the Service is also subject to our Music Guidelines.
If any aspect of this agreement is unenforceable, the rest will remain in effect.
We reserve all rights not expressly granted to you.

Who Has Rights Under this Agreement

This agreement does not give rights to any third parties.
You cannot transfer your rights or obligations under this agreement without our consent.
Our rights and obligations can be assigned to others (e.g., in a merger or sale of assets).

Who Is Responsible if Something Happens

Our Service is provided "as is," and we can't guarantee it will be safe and secure or will work perfectly all the time.
TO THE EXTENT PERMITTED BY LAW, WE ALSO DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
OUR RESPONSIBILITY FOR ANYTHING THAT HAPPENS ON THE SERVICE (LIABILITY) IS LIMITED AS MUCH AS THE LAW WILL ALLOW. IN ALL CIRCUMSTANCES GLAMILY'S MAXIMUM LIABILITY IS LIMITED TO $100.

How We Will Handle Disputes

You and we agree that any cause of action, legal claim, or dispute must be resolved by binding, individual arbitration. Class actions and class arbitrations are not permitted.
Before you commence arbitration, you must provide us with a written Notice of Dispute.
The laws of the State of Washington will govern these Terms and any claim.

Unsolicited Material

We always appreciate feedback or other suggestions, but may use them without any restrictions or obligation to compensate you for them.

Updating These Terms

We may change our Service and policies, and we may need to make changes to these Terms. Unless otherwise required by law, we will notify you before we make changes and give you an opportunity to review them before they go into effect.
